欢迎您使用上海缘起网络技术有限公司(以下简称“本公司”、“我们”)提供的应用程序(以下简称“本APP”或“本服务”)。在使用本服务前,请您仔细阅读并充分理解本《用户协议》(以下简称“本协议”)。当您点击“同意”或实际使用本服务,即视为您已阅读、理解并同意接受本协议全部条款的约束。

重要提示:本APP不提供医疗诊断或心理治疗建议,相关内容仅用于情绪管理与日常参考。若您需要专业意见,请咨询专业医师或持证心理咨询师。

一、协议生效与修改

1. 您使用本服务,即表示您已充分理解并同意本协议全部内容。

2. 我们有权根据业务需要不时修订本协议,并通过APP内公告、弹窗或其他合理方式进行通知。修订后的协议自发布之时起生效;您继续使用本服务的行为构成对修订后协议的接受。

二、账号注册

1. 您应保证注册信息真实、准确、完整,并在信息变更时及时更新。我们有权核验并在发现虚假信息时暂停或终止服务。

2. 账号仅供本人使用,不得转让、出租、出借或授权他人使用。因您保管不善造成的损失由您自行承担。

三、服务说明与使用规则

1. 适用人群与年龄限制:本APP仅面向年满18周岁的用户提供服务。未满18周岁的用户请勿使用本APP。如我们发现未成年人使用,我们有权立即采取限制或终止服务的措施,并删除相关信息。如您正在接受医疗诊断或心理治疗,请优先遵循医生或其他专业人士的意见,并在必要时停止使用本APP。

2. 非医疗声明与风险提示:本APP提供的建议、练习、训练及互动内容仅用于日常情绪管理和自我关怀参考,不构成医学诊断或心理治疗意见,亦不可替代医疗服务或专业心理咨询。如您存在或怀疑存在心理疾病、精神障碍或其他健康风险,请务必及时寻求具有资质的医生或持证心理咨询师的帮助。您应自行判断是否采纳本APP的内容,并自行承担因依赖或使用本APP内容而产生的风险与后果。本公司对于用户将本APP内容作为专业医疗替代而导致的任何损失,不承担责任。

3. 权限最小化:我们仅在功能必需时请求相应系统权限;如您不同意授予,可能影响相关功能使用,但不影响访问其他无需该权限的功能。

四、用户行为与内容管理(UGC)

1. 您不得利用本服务从事违法违规或损害他人/本公司合法权益的行为,包括但不限于:发布违法信息、冒用他人身份、攻击/破坏系统、恶意注册、刷量作弊等。

2. 您对所发布内容(含文字、图片、音视频、生成内容等)应享有相应权利或已获合法授权,不得侵犯第三方的知识产权、肖像权、隐私权及其他合法权益。

3. 社区与内容治理:我们提供内容过滤、举报、拉黑/屏蔽、删除等功能。如发现违反本协议或法律法规的内容,我们有权在不通知您的情况下删除或采取限制措施,并视情节追究相关责任。

五、深度合成/生成式人工智能规范

1. 风险提示

AI 相关输出由算法基于概率生成,可能存在不完整、不准确、延迟或具有误导性的情况,尤其涉及数字、时间、事实描述等。您应保持独立判断并自行核实,据此使用的风险和后果由您自行承担。

2. 免责声明

我们不就AI生成内容的真实性、准确性、合法性、有效性、适用性或完整性作出任何明示或默示担保,也不对您因依赖或使用该等内容而产生的直接或间接损失承担责任。

3. 标识管理

我们对生成内容进行显著标识,提示其为AI生成。您不得删除、篡改、隐匿或规避该标识,否则我们有权采取暂停服务、封禁账号、追究法律责任等措施。

六、知识产权与授权

1. 用户原创/发布内容

您确认在本APP中发布的原创内容的知识产权归您或相关合法权利人所有。您授予我们全球范围内免费的、非独家、可再授权的有限使用权,仅用于与本服务相关的运营、展示、存储、备份、安全与合规之必要目的。本公司不会将您的原创内容用于与服务无关的商业用途。

2. AI 生成内容版权与使用说明

内容归属:您通过本APP提供的 AI 功能生成的图片、文本及其他内容(“生成内容”),在法律允许的范围内,您享有使用权,包括保存、分享、展示和利用生成内容。若相关法律承认其著作权归属,则该权利归您本人所有。 用户权利与责任:您可在遵守法律法规及本协议的前提下,自由保存、分享、展示和使用生成内容。如用于商业目的,您需自行确保不侵犯任何第三方合法权利(包括但不限于知识产权、肖像权、隐私权),因此产生的纠纷或责任由您自行承担,本公司不承担相关责任。

用户权利与使用:用户可在遵守法律法规及本协议前提下,自由保存、分享、展示和使用生成内容。如用于商业目的,用户应自行确保不侵犯任何第三方权利;因此产生的纠纷或责任由用户自行承担,我们不承担相关责任。

平台有限使用权:为向您提供服务、改进和优化算法、维护系统安全及履行法律合规义务,本公司在必要范围内享有对生成内容的合理使用权,包括但不限于存储、展示、备份、技术调试和风险监测。除上述目的外,本公司不主张对用户生成内容享有任何版权或所有权。

禁止行为:您不得利用生成内容从事违法、侵权或不当行为,包括但不限于:制作、传播色情、暴力、歧视、仇恨内容;侵犯第三方知识产权、肖像权或隐私权;以及其他违反法律法规和公序良俗的用途。

免责声明:本公司不保证生成内容的原创性、独特性或不侵权性。您应自行判断并承担因使用生成内容可能引发的风险、纠纷或法律责任。本公司不对因生成内容引发的直接或间接损失承担责任。

七、付费服务、自动续费、恢复购买与退款

1. 内购与订阅:本APP内的所有数字内容和服务仅通过 Apple 的应用内购买(IAP)完成。价格、周期、权益以购买页展示为准。

2. 订阅文案一致:购买页显示的价格、周期、权益与此协议及 App Store Connect 配置一致。

3. 自动续费:订阅默认为自动续费,Apple 会在到期前通过您绑定的 Apple ID 扣费。您可在设备内进入 “管理订阅” 进行取消或变更。未取消视为继续授权。

4. 恢复购买:已购买用户可通过【设置 → 会员中心 → 恢复购买】恢复权益(不会重复扣费)。如您从未购买过,将给出无可恢复项的提示。

5. 退款申请:如需退款,请通过 Apple 的官方渠道提交:申请退款。我们不直接处理通过 Apple 完成的扣费退款。

6. 失败与中止:若自动续费扣款失败,我们可暂停或终止付费权益;因此造成的损失由您自行承担,已享受的服务不退还。

八、数据与账户管理

1. 账号删除:我们在应用内提供 【我的 → 设置 → 账号 → 注销账户】 的入口。删除账户后,我们将删除或匿名化与您账号相关的个人数据(法律法规另有要求的除外)。

2. 用户内容删除:您可随时删除聊天记录、单日情绪记录,并可一键清空。删除后内容将从用户侧不可见并按我们的数据策略从服务器删除或在合理时间内彻底清除。

删除对话记录:路径【我的 → 最近使用】

删除情绪状态:路径【今日 → 今日情绪(情绪扫描)→ 历史记录(右上角)】

3. 数据导出(可选):如本APP提供导出能力,您可在设置中导出部分数据以备份/迁移。

九、责任限制与免责

1. 本服务按“现状”提供。我们不保证服务的连续性、及时性或无错误。

2. 因不可抗力或第三方原因导致的服务中断、数据丢失或损失,我们不承担责任。

3. 用户或第三方发布内容的真实性、合法性由发布者自行负责;我们不对因此产生的任何责任承担连带责任。

4. 在法律允许范围内,我们的赔偿责任上限不超过您已实际支付且尚未履行部分对应的服务费用。

5. 用户保证与赔偿:如因您违反本协议或侵害第三方权益而导致我们遭受索赔、损失或处罚,您同意赔偿并使我们免责。

十、协议终止

1. 如您严重违反本协议,我们有权随时暂停或终止对您的全部或部分服务。

2. 您可在取消订阅并结清相关费用后申请注销账号。账号注销后,相关数据将被删除或匿名化,不提供恢复。

十一、法律适用与争议解决

本协议适用中华人民共和国法律。因本协议产生的争议协商不成的,提交我们住所地有管辖权的人民法院诉讼解决。

十二、Apple 相关条款

1. 您理解并同意,Apple Inc. 及其子公司为本协议的第三方受益人,但并非本协议一方。有关应用内购买、订阅、扣费、退款及账单的处理,适用 Apple 的相关条款与流程。

2. 当本APP通过 Apple 提供的分发与计费机制向您提供数字内容/服务时,相应的订阅管理、退款申请、支付争议等应通过 Apple 渠道处理。

十三、其他

1. 本协议部分条款被认定无效或不可执行的,不影响其余条款的效力。

2. 本协议的标题仅为阅读方便,不影响条款含义。

3. 中英文版本不一致时,以中文版本为准(境外用户可参考英文译本)。

Welcome to the App

Welcome to the application (“App”) provided by Shanghai Yuanqi Network Technology Co., Ltd. (“Company”, “we”, “us”). Please read this Terms of Service (“Agreement”) carefully before using the Services. By tapping “Agree” or continuing to use the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

Important: The App does not provide medical diagnosis or psychotherapy. All content is for everyday emotional well-being and reference only. Seek advice from licensed professionals when needed.

1. Effectiveness & Amendment

(1) Your use of the Services signifies your consent to the entire Agreement.

(2) We may amend this Agreement from time to time. Once posted in-App, the amended version takes effect immediately. Your continued use constitutes acceptance.

2. Account Registration

1.You must provide accurate information and keep it updated.

2.Accounts are personal and non-transferable. You are responsible for safeguarding your credentials.

3. Service Description and Usage Rules

(1) Target Users and Age Restriction: This App is intended only for users aged 18 and above. Users under 18 are strictly prohibited from using the App. If we discover that a minor is using the App, we reserve the right to immediately restrict or terminate the service and delete related information.If you are undergoing medical diagnosis or psychological treatment, you should follow the advice of your doctor or other licensed professional, and discontinue use of the App if necessary.

(2) Non-Medical Disclaimer and Risk Notice: The suggestions, exercises, training, and interactive content provided by this App are intended solely for daily emotional management and self-care reference. They do not constitute medical diagnosis or psychotherapy advice, nor should they be used as a substitute for medical services or professional psychological counseling.If you have, or suspect you may have, a mental illness, psychological disorder, or other health risks, you must promptly seek help from a qualified doctor or licensed psychological counselor.You are solely responsible for deciding whether to rely on or act upon the App’s content, and you assume all risks and consequences arising from such reliance or use. The Company shall not be liable for any loss resulting from using this App as a substitute for professional medical treatment.

(3) Minimal Permissions: We request OS permissions only when necessary; declining a permission may limit related features but not the rest of the App.

4. User Conduct & UGC

You shall not engage in unlawful or harmful activities.

You must own or have rights to any content you post and shall not infringe any third‑party IP, portrait, or privacy rights.

We provide content filtering, reporting, and block/delete tools and may remove violative content without notice.

5. Generative AI Rules

Risk: AI outputs are probabilistic and may be incomplete, inaccurate, delayed, or misleading, especially for factual details. Use discretion.

Disclaimer: We make no warranties regarding authenticity, accuracy, legality, validity, applicability, or completeness of AI‑generated content and are not liable for reliance losses.

Labeling: AI‑generated content will be labeled; do not remove or circumvent such labels.

6. Intellectual Property and License

1. User-Created/Published Content

You confirm that the intellectual property rights of any original content you publish in the App belong to you or the relevant lawful rights holder. You grant us a worldwide, free, non-exclusive, sublicensable, and limited license to use such content solely for purposes necessary to operate, display, store, back up, ensure security, and comply with applicable laws. The Company will not use your original content for unrelated commercial purposes.

2. AI-Generated Content: Copyright and Usage

Ownership: For images, text, and other materials generated through the AI features of this App (“Generated Content”), you shall enjoy the right to use them, including saving, sharing, displaying, and utilizing them, within the scope permitted by law. Where copyright is legally recognized for AI-generated works, such rights shall belong to you.

User Rights and Responsibilities: You may freely save, share, display, and use Generated Content, provided such use complies with applicable laws and this Agreement. For commercial use, you are solely responsible for ensuring that no third-party rights (including intellectual property, portrait rights, or privacy rights) are infringed. Any disputes or liabilities arising therefrom shall be borne by you, and the Company shall not be liable.

Company’s Limited Rights: To provide services, improve and optimize algorithms, maintain system security, and fulfill legal or compliance obligations, the Company retains a reasonable right to use Generated Content within a limited scope, including but not limited to storage, display, backup, technical debugging, and risk monitoring. Apart from these purposes, the Company does not claim copyright or ownership of user-generated content.

Prohibited Uses: You must not use Generated Content for unlawful, infringing, or inappropriate purposes, including but not limited to: producing or distributing pornographic, violent, discriminatory, or hateful content; infringing third-party intellectual property, portrait rights, or privacy rights; or any other purposes that violate laws, regulations, or public order and good morals.

Disclaimer: The Company makes no guarantee regarding the originality, uniqueness, or non-infringement of Generated Content. You are solely responsible for evaluating and assuming any risks, disputes, or liabilities arising from your use of such content. The Company shall not be liable for any direct or indirect losses caused by or related to Generated Content.

7. Billing, Auto‑Renew, Restore Purchases & Refund

(1) In‑App Purchases: All digital content/services are sold via Apple IAP. Prices, periods, and benefits are as displayed in the paywall.

(2) Consistent Subscription Copy: The price, duration, and benefits displayed on the purchase page must match those specified in this agreement and in the App Store Connect configuration.

(3) Auto‑Renew: Subscriptions auto‑renew via your Apple ID. Manage or cancel via Manage Subscriptions. Failure to cancel implies continued authorization.

(4) Restore Purchases: Use Settings → Membership → Restore Purchases to restore entitlements (no double‑charge). If no prior purchase exists, you will be notified accordingly.

(5) Refunds: For refunds, apply through Apple’s official channel: Request a refund. We do not directly process Apple‑billed refunds.

(6) Failure: If auto‑renewal fails, paid benefits may be suspended/terminated; consumed services are non‑refundable.

8. Data & Account Management

(1) Account Deletion: We provide an in-app function [My → Settings → Account → Cancel Account]. Upon deletion, we delete or anonymize related personal data unless retention is legally required.

(2) User Content Deletion: You may delete chat logs and daily mood records at any time and also clear them in bulk. Once deleted, the content will no longer be accessible to you and will be removed from our servers or permanently purged within a reasonable time according to our data policy.

(3) Data Collection: For details about how we collect, use, store, and protect your personal information, please refer to our Privacy Policy: Privacy Policy URL Address.

9. Limitation of Liability

Services are provided “as is.” We do not warrant uninterrupted, timely, error‑free operation. We are not liable for interruptions/data loss due to force majeure or third parties. Publishers are responsible for their content. To the extent permitted by law, our maximum aggregate liability shall not exceed the fees you paid for undelivered Services. You agree to indemnify us against claims arising from your breach or infringement.

10. Termination

We may suspend/terminate Services for material breach. You may cancel subscriptions and request account deletion; once deleted, data is removed or anonymized and cannot be restored.

11. Governing Law & Disputes

This Agreement is governed by the laws of the People’s Republic of China. Disputes shall be submitted to the competent court at our domicile if not resolved amicably.

12. Apple‑Related Terms

Apple Inc. and its subsidiaries are third‑party beneficiaries of this Agreement but are not parties hereto. Matters regarding IAP/subscriptions/billing/refunds are handled under Apple’s terms and processes.

13. Miscellaneous

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Headings are for convenience only. In case of inconsistency between Chinese and English, the Chinese version prevails.
